TERMS AND CONDITIONS

1.1 These Terms and Conditions ("Terms") govern your access to and use of the website abcmoneytools.com and its related tools and services, branded "ABC Money Tools" and powered by TX Edu Group (collectively, the "Services"), operated by TRADERPRENEUR XCELLENCE SDN BHD ("we", "us", or "our").

1.2 By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

1.3 These Terms should be read together with our Privacy Policy, which explains how we collect and use personal data.

• "Account" means the registered user account you create to access the Services.
• "Money Tracker" means the free transaction, asset, debt, budget, and goal-tracking tool, including the receipt-scan feature.
• "Workbook" means the Financial Workbook/Assessment, a one-time paid, multi-section self-assessment that produces an AI-generated personalised report.
• "Indicators" means the invite-only TradingView indicator scripts made available on a subscription basis.
• "User Content" means data, answers, files, or other content you submit through the Services, including receipts and Workbook answers.
• "You" or "User" means the individual using the Services under an Account.

3.1 Eligibility. You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into a binding contract, to create an Account or use the Services.

3.2 One account. Each user may maintain only one Account. You must provide accurate, current, and complete information when registering and keep it up to date.

3.3 Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us immediately at [email protected] if you suspect unauthorised access to or use of your Account.

3.4 We reserve the right to suspend or terminate an Account that provides false, inaccurate, or misleading information.

We offer the following products, each subject to the specific terms below in addition to these general Terms:

4.1 Money Tracker (free). Lets you log transactions, assets, debts, budgets, and financial goals, including a "scan receipt" feature where you upload a receipt image or PDF and an AI service extracts the transaction data for you to review and confirm.

4.2 Financial Workbook / Assessment (one-time paid purchase). A multi-section self-assessment covering areas such as retirement readiness, portfolio review, net worth, peer ranking, and a 12-month action plan, which collects your financial figures and produces an AI-generated personalised synthesis/report.

4.3 TradingView Indicators (subscription). Grants access to invite-only TradingView indicator scripts on a monthly or yearly, auto-renewing subscription basis, described in Section 7 below.

5.1 Pricing. Current prices for the Workbook and Indicator subscriptions are listed at www.abcmoneytools.com/indicator and are stated in Malaysian Ringgit (RM), inclusive or exclusive of applicable taxes as indicated at checkout.

5.2 Workbook purchase. The Workbook is a one-time purchase. Once paid, you gain access to the Workbook and its results for as long as your Account remains active, subject to Section 6.

5.3 Indicator subscriptions. Indicator access is billed on a recurring monthly or yearly basis via Stripe and will automatically renew at the then-current price at the end of each billing period until you cancel.

5.4 Taxes. You are responsible for any applicable taxes (such as sales tax, service tax, or SST) associated with your purchase, except where we are required by law to collect them.

5.5 Payment processing. All payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

5.6 Failed payments. If a subscription renewal payment fails, we may suspend your access to the relevant Indicators until payment is successfully made, and may retry the charge or notify you to update your payment method.

6.1 Cancelling a subscription. You may cancel your Indicator subscription at any time through your Account settings or by contacting [email protected]. Cancellation stops the next renewal charge; you will retain access to the Indicators until the end of your current paid billing period.

6.2 Refunds -- general. Refund requests are considered on a case-by-case basis.

6.3 Refunds -- Workbook. Because the Workbook is a one-time digital purchase that grants immediate access to content, once you have accessed the Workbook or its generated results, the purchase is generally non-refundable, except where required by applicable consumer protection law or at our discretion.

6.4 Refunds -- Indicators. If a refund is approved for an Indicator subscription charge, your access to the corresponding Indicators will be revoked as described in Section 7.4.

6.5 Nothing in this Section limits any statutory right to a refund that cannot be excluded under Malaysian law.

7.1 TradingView username required. To receive access to Indicators, you must provide an accurate and current TradingView username. You are responsible for ensuring this username is correct; we are not responsible for access granted to an incorrect username you provided.

7.2 Access grant. Access is granted directly to the TradingView username you provide, via TradingView's invite-only script access system.

7.3 No affiliation with TradingView. We are an independent provider of Indicators built for use on the TradingView platform. We are not affiliated with, endorsed by, or sponsored by TradingView. "TradingView" is a trademark of its respective owner.

7.4 Revocation of access. We will revoke your Indicator access upon cancellation of your subscription (at the end of the paid period), an approved refund, or a chargeback initiated on your payment. We may also revoke access for breach of these Terms, including the prohibited conduct described in Section 8.

7.5 Platform dependency. Access to and functionality of the Indicators depends on TradingView's platform, which we do not control. We are not responsible for outages, changes, or limitations imposed by TradingView that affect your access to or use of the Indicators.

You agree not to:

• Share, resell, sublicense, or otherwise provide your Account access, Workbook results, or Indicator access to any third party
• Provide a TradingView username that does not belong to you, or share Indicator access via a username you do not control
• Scrape, crawl, or use automated means to extract data from the Services, other than normal use of the Money Tracker
• Reverse-engineer, decompile, or attempt to derive the underlying logic or source code of the Indicators or any other part of the Services
• Initiate a fraudulent or bad-faith chargeback or payment dispute where you have received the Services as described
• Abuse the AI features (for example, by attempting to extract the underlying AI models, submitting content designed to manipulate or overload the AI systems, or using the features for any unlawful purpose)
• Use the Services for any unlawful purpose or in violation of any applicable law or regulation

We reserve the right to suspend or terminate your Account for any violation of this Section.

9.1 We (or our licensors) own all right, title, and interest in and to the Services, including the Site, the Money Tracker, the Workbook, the Indicators, and all related content, software, designs, text, and materials (excluding your User Content).

9.2 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use.

9.3 You retain ownership of your User Content. By submitting User Content, you grant us a licence to use it solely to provide the Services to you (for example, sending Workbook answers to Anthropic to generate your report, or sending receipt uploads to Google to extract transaction data).

9.4 No other rights are granted to you under these Terms, whether by implication, estoppel, or otherwise.

10.1 The Money Tracker, the Workbook, any AI-generated reports or syntheses, and the Indicators are provided for EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. They do not constitute financial, investment, tax, accounting, or legal advice, and should not be relied upon as such.

10.2 We do not guarantee any particular outcome, result, return, or level of performance from using the Services, including from following any Workbook recommendations, AI-generated report, or trading Indicator.

10.3 Trading and investing involve risk, including the risk of loss of some or all of your capital. Past performance is not indicative of future results. You are solely responsible for your own financial and trading decisions.

10.4 We are not a licensed financial adviser and are not regulated as one.

10.5 You should consult a licensed and qualified financial adviser before making any financial or investment decision.

The Services rely on and integrate with third-party services, including Stripe (payments), TradingView (indicator hosting and access), Anthropic (AI report generation), and Google (AI receipt extraction). Your use of features involving these providers is also subject to their respective terms of service, which we encourage you to review. We are not responsible for the acts, omissions, availability, or performance of these third-party services.

12.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH WARRANTIES CANNOT BE EXCLUDED UNDER APPLICABLE MALAYSIAN LAW.

12.2 We do not warrant that the Services will be uninterrupted, error-free, or secure, or that AI-generated outputs (including Workbook syntheses and receipt-scan extractions) will be accurate, complete, or free of error. You should review AI-extracted data (such as scanned receipt details) before relying on it.

13.1 To the maximum extent permitted by Malaysian law, our total aggregate liability to you arising out of or relating to these Terms or the Services shall not exceed the total amount you have paid to us in the 12 months preceding the event giving rise to the claim.

13.2 To the maximum extent permitted by Malaysian law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Services, including any reliance on Workbook results, AI-generated reports, or Indicators.

13.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Malaysian law, including liability for fraud or wilful misconduct.

You agree to indemnify and hold us, our officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your use or misuse of the Services, including any TradingView username you provide.

15.1 By us. We may suspend or terminate your Account, in whole or in part, if you breach these Terms, engage in prohibited conduct under Section 8, or where required to comply with law or protect the security or integrity of the Services. Where reasonably possible, we will provide notice of suspension or termination.

15.2 By you. You may close your Account at any time by contacting [email protected]. Closing your Account will cancel any active subscription for future billing periods but does not automatically entitle you to a refund for amounts already paid, except as described in Section 6.

15.3 Effect of termination. Upon termination, your right to access the Services ends, including access to the Workbook and any Indicators. Sections of these Terms that by their nature should survive termination (including Sections 9, 10, 12, 13, 14, and 17) will survive.

16.1 We may modify, suspend, or discontinue any part of the Services at any time, including adding or removing tools or features.

16.2 We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date, and where changes are material, we will make reasonable efforts to notify you (for example, by email or a notice on the Site). Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

17.1 These Terms are governed by the laws of Malaysia, without regard to its conflict-of-law principles.
